OKLAHOMA CITY — A federal appeals court has upheld the dismissal of an Oklahoma doctor's lawsuit against a Tulsa hospital that suspended his medical privileges.
The 10th U.S. Circuit Court of Appeals handed down the decision Friday in the lawsuit filed by Dr. George Cohlmia, a cardiovascular and thoracic surgeon in Tulsa.
Cohlmia sued St. John Medical Center in Tulsa after the hospital suspended his medical privileges following a pair of surgeries in June 2003. A patient died a week after one of the surgeries and the other procedure resulted in permanent disfigurement.
Cohlmia's lawsuit asserted federal and state antitrust claims as well as allegations that his business was harmed. The case was dismissed after the hospital claimed it was immune from damages under federal law.
Cohlmia's attorney, Michael L. Barkett, declined comment.
