FARGO, N.D. (AP) — The custody battle for the daughter of a slain North Dakota dentist will linger into next spring.
A hearing on permanent guardianship of 3-year-old Kennedy Gattuso has been set for April 14 in Fargo.
A judge has given Philip Gattuso's brother Roy, of Gretna, La., emergency custody of his niece. Philip Gattuso's sister-in-law, Regan Williams, of Jones, Okla., wants custody.
Gattuso was found beaten to death in his south Fargo home in October. His wife, Valerie, died in March after an extended illness.
Sixty-three-year-old Gene Kirkpatrick of Jones, Okla., is accused of paying his handyman, Michael Nakvinda, $3,000 to kill Philip Gattuso, who was Kirkpatrick's son-in-law.
Kirkpatrick allegedly arranged the killing because he did not agree with the way his granddaughter was being raised. Nakvinda is charged with murder.
