TAHLEQUAH, Okla. (AP) — Cherokee County prosecutors have filed a first-degree murder charge against a man for a fatal shooting at Lake Tenkiller two years ago.
Daniel Prentice Thornburg testified in Robert Lee Smallen's murder trial in April, but jurors deadlocked.
Authorities have accused Thornburg of aiding and abetting Smallen in the July 2007 killing of Ronnie Hall, who was shot several times near the confluence of Lake Tenkiller and the Illinois River.
Smallen is scheduled to be retried next month.
Assistant District Attorney David Pierce says Thornburg is expected to surrender to authorities by the end of the week.
