Prosecutors expect the jury in a trial for a Muskogee man charged in a 2011 Wagoner rape to reach a verdict today.
Darvain Dewayne Brewer, 22, is charged with first-degree rape by force or fear and domestic assault and battery against a pregnant woman.
District 27 District Attorney Brian Kuester said the state rested its case Thursday afternoon.
Documents filed in the case state Brewer was charged Oct. 21, 2011, after an investigation into an alleged rape and beating of a Wagoner woman.
The woman told investigators she had been in an argument with Brewer the night of the alleged attack, but he had left and she had gone inside her mother’s house.
The woman told investigators she heard Brewer asking for her to come over to a trailer located on her mother’s property later that day, and went inside because Brewer promised not to touch her.
The woman stated that once she went inside the trailer, Brewer threw her on the bed, and began punching her in the face and head. She also stated Brewer knew she was 15 weeks pregnant, and began trying to punch her in the stomach, but she blocked his attempts.
The affidavit states the woman told investigators Brewer raped her after the initial attack, then tied her up with a shoelace, and began striking her backside with an electrical cord.
Brewer then allegedly told the woman not to tell anyone “or she would get it worse.”
The report states a sexual assault nurse examiner performed an exam and found injuries consistent with the woman’s account.
When Brewer was arrested, the report states he told investigators he and the woman had consensual sex, but he had not hit her and was not mad at her the night of the alleged attack. Investigators said Brewer told them he had hurt her before, but had been on PCP at the time and didn’t remember doing it.
