Gray gets 10 years for crime

A Muskogee man pleaded guilty Thursday to the rape, sodomy and molestation of a juvenile female at the Castle of Muskogee last year.

Darvin Wayne Gray, 49, will spend 10 years in the Oklahoma Department of Corrections, with 20 years probation following his release, Muskogee County assistant district attorney Nikki Baker said.

Baker said the agreement was reached with the support of the juvenile’s family.

Gray pleaded guilty to:

• Rape by instrumentation;

• Forcible oral sodomy; and

• Lewd molestation.

The felonies fall under Oklahoma’s 85 percent statute, so Gray will be required to spend the next 8 1/2 years in prison before being eligible for release.

Gray faced a maximum punishment of up to 20 years in prison.

The attack on the juvenile girl took place Oct. 21, 2011, at the Castle of Muskogee’s Halloween Festival.

Supplemental information filed in the case state Gray was convicted of:

• Possession of controlled substance March 31, 2005, in Muskogee County;

• Attempting to obtain money by false pretense Aug. 7, 1996, in Muskogee County; and

• Two counts of lewd molestation and one count of lewd proposal to a minor Oct. 28, 1988, in Wagoner County.

 He received a 10-year sentence in that case with five years suspended.
