The trial for a Muskogee man charged in a July 2007 shooting death was postponed until June 11.
Robert Lee Smallen, 60, is charged with first-degree murder.
Authorities said Smallen shot Ronny Hall near the Horseshoe Bend area of Lake Tenkiller. Hall’s body was found floating in the water.
Smallen’s attorney, Rex Earl Starr, requested the continuance Monday, saying a witness to the shooting, Daniel Thornburg, had “competency issues.”
Thornburg was ordered Thursday to complete a mental health evaluation before the trial’s new date.
