Hearing delayed in pizza delivery robbery
A Muskogee man charged with beating a pizza deliveryman in the head with an aluminum bat in September 2007 is considering an insanity plea, a prosecutor said Wednesday.
Robert Jay Peters, 20, earlier gave up his right to a preliminary hearing and sought a delay in a docket hearing while awaiting a psychologist’s report, Muskogee County Assistant District Attorney James Walters said.
Peters is expected to be given a plea date or be assigned a trial date at a docket hearing at 9 a.m. Jan. 23, Walters said.
Co-defendant Christina Hall, 20, pleaded guilty in January and was sentenced to two, eight-year prison sentences to be served concurrently.
Jesse Lee Moler, 26, was convicted in February and sentenced to serve 25 years on an assault charge and eight years for conspiracy to commit robbery in the attack on pizza deliveryman Jason Rush.
