Ex-band teacher pleads guilty

Former educator gets no time in prison for forcible sodomy conviction

A former Haskell band director pleaded guilty Monday to two counts of forcible sodomy involving a former juvenile student.

Larry Dean Scheer, 59, entered into a plea agreement, agreeing to a term of 20 years suspended on each count. Each count is to run concurrent with the other. That means Scheer gets no prison time if he doesn’t break the law within the next 20 years.

He will have to register as a sex offender, said Muskogee County Sheriff Investigator Faye Banks.

Scheer also was assessed a $500 fine, according to court filings.

An affidavit filed in the initial court filing states one incident occurred in December 2007 and the second on Jan. 4, 2008. Both incidents occurred in a band practice room at Haskell High School, the affidavit states.

The juvenile told a deputy in the first incident Scheer removed her shirt and bra, pulled down his pants and begged her to give him oral sex.

The girl said Scheer told her, “Make an old man happy.” She said when she told him “No” he placed his hands on her head and forced her to perform oral sex on him.

The juvenile’s mother advised deputies she was looking at her daughter’s cell phone and listened to the voice messages on Jan. 11, 2008. She discovered several messages were sexual in nature, and the voice sounded like that of an older male.

The mother made a report to the Muskogee County Sheriff’s Office. Banks began an investigation.

The affidavit states Scheer gave the juvenile a phone number to contact him by that was the same number used to leave the messages on her cell phone.

Scheer had been at the school five or six years when the incidents occurred, said Haskell Superintendent Landon Berry.

Richard O’Carroll, defense attorney, said Scheer is going to turn in his teaching certificate and start a new career as a truck driver.

“The sentence today was best for everybody,” O’Carroll said. “The girl did not want to testify.”
