A mistrial was declared after a Muskogee County District Court jury deadlocked on whether to convict Darrico Cade, 26, of first-degree rape.
Cade was accused in a June 26 assault of a 13-year-old girl on the couch at a Muskogee residence.
Nikki Baker Dotson, assistant district attorney, said she plans to retry the case and expects it to be put on another jury docket this fall.
She said Cade faces the possibility of 20 years to life if convicted because he has four previous felony convictions.
His attorney, Mike Littlefield, said jurors deliberated six hours before they told a judge they were unable to reach a verdict Thursday night.
