Ex-Hilldale band teacher charged

Bond was again denied Friday for former Hilldale High School and Middle School band director Danny Brian Giacomo, 36, who has been charged with two felony counts of lewd molestation and a misdemeanor charge of facilitating sexual conduct with a minor by use of technology.

He is accused of having made an indecent proposal with a 15-year-old student on Sept. 1 that she should have sex with him; that he touched her in a lewd manner between Sept. 1 and Nov. 14 and that during that same period sent her e-mails “telling her he was willing to have sexual intercourse with her.”

According to testimony at Friday’s hearing from Muskogee Police Sgt. Shannon Crary, Giacomo told the girl on one occasion that his wife was going to be at work and asked her to come to his home to baby-sit.

Giacomo never left and inappropriately touched the student while his young children were in the room, Crary testified.

Giacomo’s attorney, Richard O’Carroll of Tulsa, argued again Friday that his client had not been shown to be a threat to the community or a flight risk and that he should be released on bond. He asked bond be set at $5,000 on each of the three counts.

Special District Judge Robin Adair ruled that he was denying bond because more charges are expected to be filed alleging Giacomo acted inappropriately with other students and because all of the alleged victims are juveniles.

Giacomo is to appear for a sounding docket at 9 a.m. Dec. 1.
