SALLISAW — The trial of a Gore man accused of raping two boys was postponed Monday because of the state’s failure to provide proper notice of their intent to use hearsay evidence.
Terry Gene Williams, 24, is charged in Sequoyah County District Court with two counts of lewd molestation and four counts of first-degree rape. Muskogee County Sheriff’s Investigator Tim Brown said Williams was a longtime acquaintance of his alleged victims’ family.
Williams’ lawyer, Donn Baker, said the prosecution was forced to ask for a continuance after Baker filed a motion contesting the state’s notice to use hearsay evidence. Baker said the notice must be filed 10 days before trial, and that wasn’t done.
Before the continuance was granted, Baker was able to get his client’s bond reduced to $10,000. Williams has been in Sequoyah County Jail since he was arrested Sept. 19, 2005.
According to Brown, Williams faces similar charges in Muskogee County.
