A Muskogee man was charged Friday with first-degree rape.
Muskogee County District Court records state Austin Lee Rose, 19, was charged with having sexual intercourse with a 12-year-old girl on Dec. 19.
“A child under the age of 14 can’t give consent,” Assistant District Attorney Nikki Baker said.
Rose is held on $100,000 bond at the Muskogee County/City Detention Facility on $100,000 bond.
A sounding docket in his case is set for 9 a.m. Feb. 17. At that time, a date will be set for testimony.
Upon conviction, first-degree rape is punishable by not less than five years in prison.
