Muskogee County prosecutors are waiting for a report to determine whether to charge a teen in a deadly crash.
Tyler Alred, 16, was driving a 2009 Chevrolet pickup at 4 a.m. Saturday about 4 miles east of Muskogee near Hopewell Park. The pickup ran off the road and struck a tree, causing the vehicle to go airborne, states an Oklahoma Highway Patrol report.
Alred’s passenger, John Luke Dum, 16, was ejected, and the vehicle landed on top of him. Dum was pronounced dead at the scene by Muskogee County Emergency Medical Service. Another passenger, Cesar Sanchez, 16, was not injured. Neither Alred nor Dum were wearing seat belts, the report states.
Alred was released to his guardian, said Muskogee County District Attorney Larry Moore.
Alred will not be arrested unless prosecutors decide to charge him.
According to Oklahoma statutes, anyone under 21 who has a measurable amount of alcohol in their system may be prosecuted for driving under the influence, Moore said.
“If there’s a fatality involved and they are drinking and driving, they could be booked for manslaughter,” Moore said. “That is the appropriate charge.”
Charges have not been filed against Alred. Moore said he has not received the collision report from J.W. Duerson, the OHP trooper who worked the crash.
Funeral services for Dum, a Muskogee High School student, are set for 10 a.m. Friday at St. Joseph Catholic Church under the direction of Foster-Petering Funeral Home.
