Area man jailed in break-in, assaults

— TAHLEQUAH — A Tahlequah man was jailed Monday evening after he reportedly broke into a home and assaulted several people, including a 78-year-old woman he allegedly hit multiple times with a wooden rake handle.

Deputies responded to a fight call and found Daniel Eli Mullican, 24, inside a home fighting with Jack Gibson.

 In his report, Cherokee County Sheriff’s Sgt. Tom Moore said that as he entered the home, he witnessed Mullican punch Gibson in the face while they were fighting on the floor.

Several other people at the home told Moore that Mullican barged into the home and assaulted a 78-year-old woman.

Moore had to have assistance from Gibson in detaining Mullican, who was reportedly yelling, cursing and resisting Moore’s attempt to handcuff him. Moore said Mullican tried to head-butt the deputy when he was being placed into the deputy’s truck.

An ambulance was called in so paramedics could check on the victims, several of whom had suffered various injuries.

The 78-year-old victim told Moore that Mullican showed up at the home, threw her across the room so he could get into the house, and hit her on the head with a wooden rake handle several times. Gibson then came to assist and began fighting off Mullican.

When Mullican was transported to the Cherokee County Detention Center, he allegedly became angry again and threatened Moore’s life, according to Moore’s report on the incident.

Mullican was booked on complaints of assault and battery with a dangerous weapon, aggravated assault and battery, domestic assault and battery, burglary first degree, public intoxication, and threatening acts of violence toward a police officer.

Court records show Mullican was charged with a misdemeanor count of disturbing the peace last March, but the victim did not wish to prosecute and the charge was later dismissed.
